1. Who we are and what this is

These Terms govern your use of Presage Finder, proplore.ai, app.proplore.ai and related services (together, the “Service”) provided by [Presage Property legal entity name], a [North Carolina entity type] (“Presage”, “we”, “us”). By creating an account, accepting an invitation to a team, or using the Service, you agree to these Terms. If you use the Service on behalf of a brokerage or team, you represent that you are authorised to bind it, and “you” includes it.

2. What the Service is — and is not

2.1 Presage organises public records — county tax and parcel records, recorded instruments, probate and court filings, liens and judgments, code-enforcement records, business registrations and similar sources — into a daily queue for licensed real estate professionals and their teams, keeping a link to the source and the time of capture for every fact.

2.2 The Service provides preliminary public-records indicators for prioritisation only. It is not a title search, title opinion, title insurance commitment, legal advice, appraisal or broker price opinion, and it is not a prediction that any owner intends to sell. You must verify every record with the issuing office, a title company or a North Carolina attorney before relying on it.

2.3 The Service is not a consumer reporting agency and does not furnish consumer reports within the meaning of the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). You may not use the Service, or any information obtained through it, to determine a person's eligibility for credit, insurance, employment, housing or any other purpose covered by the FCRA.

2.4 Public records are incomplete, delayed and sometimes wrong. Coverage differs by county, lane and date, and where nothing has loaded the Service says so — a gap is not evidence. We do not warrant the accuracy, completeness or timeliness of any record.

3. Accounts, teams and seats

3.1 You must provide accurate account information and keep your credentials confidential. You are responsible for all activity under your account.

3.2 Teams. A team has at least one owner, who manages seats, roles, billing, invitations and the team's farm, and may have agents. Work logged by a member — outcome logs, parcel claims, notes — is part of the team's record and remains with the team after that member leaves.

3.3 Each person needs their own seat. Sharing a login is not permitted.

4. Plans, trials and billing

4.1 Plans, their limits and prices are those shown on the pricing page when you subscribe. New teams receive a fourteen-day trial with Pro limits and no payment card required; when the trial ends, features pause until a plan is chosen.

4.2 Paid plans are billed monthly in advance through Stripe, our payment processor; card numbers never reach our systems. Extra seats are billed as they are added and prorated by the processor. You may cancel at any time from the billing portal; access continues to the end of the paid period. Fees are non-refundable except where the law requires otherwise.

4.3 Founding plan. Teams we designate as founding use the Service free of charge with Pro limits for as long as we offer that plan. We may end or change it on sixty days' notice.

4.4 We may change prices on at least thirty days' notice; a change applies from your next billing period.

5. Acceptable use

You agree to use the Service only for lawful real estate business, and in particular that you will:

  1. comply with every law that governs contact with property owners, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule and the National Do Not Call Registry, North Carolina's telephone-solicitation and do-not-call laws, the CAN-SPAM Act, and federal and state fair housing laws;
  2. make calls and send letters, texts or e-mail yourself, from your own numbers and addresses, and only through the routes the Service marks as open — the Service never contacts anyone on your behalf;
  3. not use an autodialer, a prerecorded or artificial voice, or bulk texting to reach any number obtained through the Service without prior express written consent recorded in the Service;
  4. honour every do-not-contact request promptly and record it in the Service;
  5. not scrape, bulk-export, resell, sublicense or publish Service data, or use it to build or train a competing database or product;
  6. not attempt to access another team's data, probe or disrupt the Service, or circumvent plan limits or compliance gates;
  7. not use the Service for any purpose covered by the FCRA (see 2.3), for harassment, or to locate or contact a person who has asked not to be contacted.

We may suspend or terminate accounts that violate this section.

6. Your content

Notes, outcome logs, saved searches, farm settings, contacts you enter and consent records are your team's content. You grant us a licence to host, process and display that content in order to operate the Service, and to produce aggregate, de-identified statistics that never include contact details. We do not sell your content.

7. Our content and data

The Service, its software and design, and its compilations of public records belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use them through the Service for your team's business while your subscription is active. Exports and lead packets are for your team's own use.

8. Privacy

Our Privacy Policy explains what we collect and how we use it, including how we handle public-records information about property owners and requests from them.

9. Availability and changes

We may change, suspend or discontinue features at any time; a material reduction in a paid plan comes with notice. We aim for high availability but do not guarantee it.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY AND TITLE. NOTHING IN THE SERVICE IS LEGAL, TITLE, FINANCIAL OR TAX ADVICE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PRESAGE IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, COMMISSIONS OR DATA, ARISING FROM THE SERVICE; AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow some of these limits; they apply to the extent permitted.

12. Indemnity

You will defend and indemnify Presage against claims arising from your outreach to property owners or anyone else, your breach of these Terms, or your violation of law.

13. Termination

You may close your account at any time. We may suspend or terminate an account for breach, non-payment or legal risk. Sections 2, 5 to 7 and 10 to 15 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina. Disputes will be resolved in the state or federal courts located in [Buncombe County, North Carolina — venue to be confirmed by counsel], and you consent to their jurisdiction. [Counsel to decide whether an arbitration clause and class-action waiver are appropriate.]

15. Changes to these Terms

We may update these Terms. We will post the new version with its date and, for material changes, notify team owners by e-mail or inside the Service at least fourteen days before the change takes effect. Continued use after that date is acceptance.

16. Contact
